Welcome to FIJI FLOW, a private sales and brand activation platform powered by The Marketing Department LLC ("TMD"). By accessing or using this platform (the "Site" or "Service"), you agree to comply with and be bound by the following Terms of Use.
1. ELIGIBILITY FOR USE
To use FIJI FLOW, you must:
- Be at least 18 years old
- Represent or own a valid U.S. business (LLC, S-Corp, C-Corp, or Sole Proprietorship)
- Provide accurate and verifiable business details
TMD reserves the right to deny access to any user, business, or account at its sole discretion.
2. TAX RESPONSIBILITY
All users are independently responsible for reporting and paying any applicable:
- Sales tax
- Income tax
- Use tax
- Local, state, or federal taxes
TMD does not remit taxes on your behalf. You are expected to remain tax compliant according to your jurisdiction.
3. BRAND AFFILIATION NOTICE
FIJI FLOW is an independent platform hosted at FijiFlow.app and operated by The Marketing Department LLC.
FIJI WATER® is not affiliated with TMD, FIJI FLOW, or Private Exchange Imports LLC.
We are a third-party reseller of branded products under a private exchange agreement through Private Exchange Imports LLC.
4. ORDER CONFIRMATION & SHIPPING POLICY
All orders placed through FIJI FLOW must be confirmed directly with The Marketing Department LLC through the official confirmation link provided at checkout.
During confirmation, customers must:
- Submit a valid business address
- Ensure the shipping address matches the business address
- Provide a valid government-issued ID if requested
TMD reserves the right to deny or delay fulfillment if any verification fails.
📅 Confirmation Office Hours:
- Open: Monday–Friday, 9:00 AM to 5:00 PM (EST)
- Closed: Weekends and federal holidays
Orders placed after 5:00 PM EST will be processed the next business day.
📦 Shipping Timeline:
Once confirmed, please allow 5 to 15 business days for shipping. Times may vary depending on:
- Location
- Volume
- Verification clearance
- Inventory availability
5. ACCOUNT SUSPENSION & REFUND POLICY
If your account is suspended, disabled, or terminated due to user negligence or breach of terms:
- Funds will not be returned to the original payment method
- A non-transferable digital gift card of equal value will be issued by The Marketing Department LLC
- Gift cards are processed within 30 business days and redeemable within the FIJI FLOW ecosystem
6. DATA USAGE & PLATFORM CONDUCT
TMD reserves the right to collect and analyze business-related data for service improvement and fraud prevention. Misuse of the platform may result in suspension or permanent ban.
7. LIABILITY LIMITATION
TMD and Private Exchange Imports LLC are not liable for:
- Delayed shipments
- User errors in order details or address mismatches
- Tax or legal violations by users
- Disruptions caused by third-party systems or integrations
8. TERMS MODIFICATIONS
TMD may update these Terms of Use at any time. Continued use after notification constitutes agreement to the new terms.
9. GOVERNING LAW
These Terms are governed by the laws of the State of Texas.
